Immigrant Rights Under Texas SB4
Texas Senate Bill 4 (SB4) has brought concerns within immigrant communities across Houston. While the law is currently paused pending a court decision, it remains vital for immigrants to understand their rights and how this law might affect them. Working with an immigration attorney can help protect these rights and offer guidance on handling the legal complexities of SB4.
Helping clients across Houston and South Texas, Naimeh Salem & Associates PLLC is here to support immigrant families through every step of the process. Our attorneys use an educated and compassionate approach when dealing with immigration issues, as the process can be complex and overwhelming, especially when dealing with uncertain changes in the law.
What Is SB4?
SB4, passed in 2023, often called the “show me your papers” bill, allows local law enforcement officers to inquire about a person’s immigration status during routine stops. This has led to fears of racial profiling and the targeting of undocumented immigrants.
However, until the courts rule on its legality, the enforcement of SB4 is on hold. In the meantime, immigrants – both documented and undocumented – still have fundamental rights under the U.S. Constitution, including:
- The right to remain silent
- The right to an attorney
- The right to refuse to consent to a search without a warrant
Even though SB4 is not in effect and is expected to be challenged in court, immigrants in Houston must understand their rights if and when it becomes effective.
If stopped by law enforcement, you do not have to answer questions about your immigration status or where you were born. It is advisable to carry a know-your-rights card that explains this to law enforcement.
